Introduction

Digitox is owned and operated by Entrainment Pty Ltd (“Digitox, we, us or our"). Digitox is committed to protecting user privacy. We understand and appreciate that our clients are concerned about their privacy and the confidentiality and security of any personal information that may be provided to us. This privacy policy outlines how any information disclosed to Digitox is collected and used within our organisation. For the purposes of interpreting this policy, any reference to your information is also a reference to any information that you are lawfully responsible for managing (e.g. the personal information of a dependent).  

Why and when your consent is necessary  

When you register as a client of Digitox, you are providing our personnel with express consent to collect and use any information that you have disclosed or caused to have been disclosed to us, in order for our organisation to deliver its services to you in accordance with this Privacy Policy.   Only personnel who need to receive and assess such information will have access to this information. If we must deal with your information for any other purpose, we will seek additional your express consent to do so in each instance.  By registering as a client of Digitox, you warrant and represent to us that you have the legal capacity to provide your consent over the collection and use of your information.

Why do we collect, use, hold and share your personal information?

 We will need to collect your personal information to provide its services to you.  We may use your personal information directly towards any of our business activities (e.g. processing payment, business audits, training personnel and facilitating other business processes).  

What personal information do we collect?

 The information we will collect about you includes:
      •names, date of birth, addresses, contact details (e.g. telephone numbers and email addresses)
      •digital media profiles (e.g. Facebook, Instagram, TikTok, YouTube, Google and Discord profiles)
      •any information relating to your health which you voluntarily disclose to our organisation.  

Dealing with us anonymously

You have the right to deal with us anonymously or under a pseudonym unless it is impracticable for us to do so or unless we are required or authorised by law to only deal with identified individuals.  

How do we collect your personal information?

 We may collect your personal information in several different ways.

     1. When you complete and submit Digitox’s Application and Interest Form (online).
     2. When you complete and submit acceptance of Digitox’s Service Agreement (online).  
     3. When you make your first appointment with our organisation’s personnel, we may ask you to confirm the personal information you have previously disclosed.
     4. During the course of providing our services, we may collect further personal information through a variety of mediums (e.g. in person, via tele/video          
        conference, by SMS, by email, via our Digital Platforms (for more information please visit our Digital Collection Policy), when you communicate with us  
        through social media or when you make an appointment online with us.).  
     5.In some circumstances, personal information may also be collected from other sources (e.g. through a guardian or responsible person). When, why and with  
         whom do we share your personal information?

We sometimes share your personal information:

     •when we are ordered to do so by a court of competent jurisdiction (e.g. court subpoenas)  
     •when it is necessary to lessen or prevent a serious threat to a person’s life, health or safety or public health or safety, or it is impractical to obtain the patient’s             consent
     •to assist in locating a missing person
     •to establish, exercise or defend an equitable claim
     •for the purpose of confidential dispute resolution process  
     •when there is a statutory requirement to share certain personal information

Only people who need to access your information will be able to do so. Other than during the course of providing our services or as otherwise described in this policy, our organisation will not share personal information with any third party without your express consent.  

We will not share your personal information with anyone outside Australia (unless under exceptional circumstances that are permitted by law) your express consent.

Our organisation will not use your personal information for marketing any of our goods or services directly to you without your express consent. If you do consent, you may opt out of direct marketing at any time by notifying us in writing.

Our organisation may use your personal information to improve the quality of the services we offer to our patients through research and analysis of our patient data. We may provide de-identified data to other organisations to improve our service. The information is secure, patients cannot be identified and the information is stored within Australia. You can let our Privacy Officer know if you do not want your information included by writing to them at  digitoxnow@gmail.com.

How do we store and protect your personal information?

Your personal information may be stored at our organisation in various forms:

     1.electronically (e.g. file notes, photographs, videos);
     2.paper records.

Our organisation stores all personal information securely:

     1. our personnel are bound by confidentiality and non-disclosure agreements;
     2. our digital records are encrypted, password protected, stored on secured servers with access granted by way of two-step authentication;
     3. our organisation is protected by the latest anti-virus, malware and digital security software;
     4. are paper records are stored in a secure location with access to such information accessible only by our organisation’s executive team.  

How can you access and correct your personal information?  

You have the right to request access to, and correction of your personal information.  

Our organisation acknowledges that you may request access to records containing your personal information. In such circumstances, we require you to lodge a request for such access in writing to digitoxnow@gmail.com and our organisation will respond to your request as soon as reasonably practicable.  

If our organisation incurs any reasonable costs associated with the retrieval of such information, and the request is not a result of our organisation’s error, you agree that such costs may be passed on to you for payment.    

Our organisation will take reasonable steps to correct your personal information where the information is not accurate or up to date. From time to time, we will ask you to verify that your personal information held by us is correct and current. You may also request that we correct or update your information, and you should make such requests in writing to digitoxnow@gmail.com.

How can you lodge a privacy-related complaint, and how will the complaint be handled?

We take complaints and concerns regarding privacy seriously. You should express any privacy concerns you may have in writing. We will then attempt to resolve it in accordance with our resolution procedure. You may contact our Privacy Officer by writing to our organisation at digitoxnow@gmail.com. Our organisation ordinarily responds to such requests within thirty (30) days.

Policy review statement

This privacy policy will be reviewed regularly to ensure it is in accordance with any changes that may occur pursuant to the Privacy Act 1988 (Cth) any other legislation that may apply. Any amendments to this policy will be updated on this website as and when they are implemented.
